Petitioner is in custody since 25.11.2016 in connection with Sonbarsa P.S. Case No. 228 of 2016 registered under Sections 272 and 273 of the Bihar Excise (Amendment) Act, 2016. Learned counsel for the petitioner has submitted that the petitioner, who is clean antecedent, is innocent and has not committed nay offence. In fact, the petitioner happens to be the driver of the alleged vehicle has no concern with the alleged recovery as one Braj Kishore Mahto hired the vehicle from the owner of the vehicle. Nothing has been recovered from the conscious possession of the petitioner. The petitioner is rotting in custody for the last five months. Considering the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond
