JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 16-12-2015 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Habibpur P.S. Case No. 20 of 2015 registered under Section 366 of the Indian Penal Code.

Learned counsel for the petitioner submits that it would appear from the F.I.R. that petitioner is not named in the F.I.R. rather in course of investigation, the police recorded the statement of victim, Priti Kumari, under Section 164 of the Cr.P.C., in which, she has stated that she was taken by Ambika Kumar and this petitioner on motorcycle and thereafter her marriage was forcibly performed with co-accused, Ambika Kumar in presence of the family member and others. Patna High Court Cr.Misc. No.56377 of 2015 (2) dt.16-12-2015 submitted that petitioner has no criminal antecedent and is in custody since 09.09.2015. It is further submitted that co-accused, Ambika Kumar, has already been granted privilege of bail by a Bench of this Court vide order dated 06.11.2015 passed in Criminal Misc. No. 38120 of 2015.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the J.M. Ist Class, Bhagalpur, in connection with Habibpur P.S. Case No. 20 of 2015. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
