The petitioners apprehend their arrest in a case registered for the offence under Sections 307, 504, 120(B) & other allied sections of the Indian Penal Code. As per the prosecution case, all the F.I.R. named accused persons including both petitioners and 35 unknown persons obstructed the police officials and prevented them in discharging their official duties. It is further alleged that accused persons attacked the police team and caused injury and also damaged police van.

It is submitted on behalf of petitioners that there is general and omnibus allegation and specific allegation of overt act has been alleged against both petitioner. It is further submitted that petitioners have been roped in this case only on

Patna High Court CR. MISC. No.11584 of 2023(2) dt.28-04-2023 2/2 suspicion. Even petitioners were not present at the place of occurrence. Petitioners have got clean antecedent. Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad (Bihar) in connection with Deo P.S. Case No. 262 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
