2. The petitioner seeks bail in connection with Amarpur P.S. case No. 99 of 2022 instituted for the offences under Sections 147, 149, 341, 342, 323, 354, 307 of the Indian Penal Code.

3. Prosecution case, in short, is that the petitioner and the co-accused persons entered the house of the informant armed with deadly weapons and began to search Kumod Yadav. On this matter, the informant said that Kumod Yadav is not present in the house. Then the accused persons threw the informant on the ground with wrong intention. It is further alleged that this petitioner assaulted the informant by means of

4. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case. Learned counsel further submitted that there is delay of approximately 10 days in lodging the F.I.R. There is case and counter case between the parties and the petitioner has earlier lodged the case bearing Amarpur P.S. Case No. 56 of 2022 against the informant's husband and her family members. Charge-sheet has been submitted in this case under Section 147, 149, 341, 342, 323 and 307 of the Indian Penal Code. Learned counsel further submitted that there is earlier land dispute between the parties. It has been submitted on behalf of the petitioner that the petitioner is in custody since 14.07.2023 and has two criminal antecedents.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances of the case, as also the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of

Patna High Court CR. MISC. No.12976 of 2024(2) dt.04-03-2024 3/3 the like amount each to the satisfaction of Court below/concerned Court in connection with Amarpur P.S. case No. 99 of 2022.
