In this case, the petitioner is seeking bail in connection with Chanan P.S. Case No. 42 of 2015 registered for offences under sections 341, 323, 325, 504, 506, 302/34 of the Indian Penal Code and 27 of the Arms Act.
The dispute has occasioned on account of plucking the Mango fruit from the orchard.
Allegation has been made against the petitioner and one Ashlam to have caused fire arms injury to the deceased. As per statement of counsel for the petitioner, F.I.R. does not specify that whose bullet had hit at which place of body of victim as the informant is silent on this point. Except
Patna High Court Cr.Misc. No.56595 of 2015 (3) dt.05-02-2016 2/2 father and son of the informant, there is no other independence witnesses to support the prosecution story and all are hearsay witness.
As per the first information report, specific allegation has been made by the informant against the petitioner to have caused firm arms injury on the body of the deceased. In such view of the matter, this Court is not inclined to grant bail to the petitioner at this stage. Accordingly, this petition is dismissed.
