The petitioner seeks bail in a case instituted under Section 366(A)/34 of the Indian Penal Code.
The prosecution story, in brief, is that the daughter of the informant went for purchasing the books but she could not return till night of 10.07.2016 at 3.00 P.M.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 29.07.2016. The charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. At no point of time, the victim
Patna High Court Cr.Misc. No.23809 of 2017 (2) dt.24-05-2017 2/2 girl had made any objection or raises any alarm when the petitioner was moving along with the victim girl. After thought, under the pressure of her parents, she had made her 164 Cr.P.C. statement rather there was a love affair between the petitioner and the victim and they had left with consent.
On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge, Araria, in connection with S.T. No. 105 of 2017, arising out of Narpatganj P.S. Case No. 200 of 2016. (Sudhir Singh, J) Amit/- U T
