The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 452, 386 and 341 of the Indian Penal Code. It is alleged that the petitioner along with others entered into the house of the informant, assaulted the informant took away ornaments and other articles. It is submitted by learned counsel for the petitioner that due to enmity the accusation has been levelled. From the impugned order it appears that the investigation has already concluded and the charge-sheet has not been submitted under Section 386 of the IPC. Though, the petitioner is accused
Patna High Court Cr.Misc. No.3490 of 2016 (2) dt.04-02-2016 2/2 in three other cases, but in two cases he has been acquitted and in 3rd one he is on bail.
The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Arer P.S. Case No. 107 of 2013 pending in the court of learned Judicial Magistrate, Ist Class, Madhubani.
With the aforesaid observation, this application is disposed of.
