1. Heard learned counsel for the parties.
2. The petitioner has preferred this application for grant of anticipatory bail apprehending his arrest in connection with Desari (Chandpura) P.S. Case no. 8 of 2025, registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.
3. As per the prosecution case, on secret information having been received about the petitioner and co-accused Vijay Kumar Singh @ Vinay Singh having stored liquor, a raid was conducted. It is stated that Vijay Kumar Singh @ Vinay Singh was caught while the petitioner managed to flee away. On search 99 litres of indian made foreign liquor was recovered from the poultry farm of Vijay Kumar Singh @ Vinay Singh.
4. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.10757 of 2025(2) dt.07-03-2025 2/3 petitioner has been falsely implicated in the case. No incriminating article has been recovered from his possession. The only material against him is the statement of co-accused Vijay Kumar Singh @ Vinay Singh made before police. The petitioner has no concern either with the seized liquor nor with Vijay Kumar Singh @ Vinay Singh or his poultry farm from where the alleged recovery is said to have taken place. He has no criminal antecedent.
5. The application for anticipatory bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegation against the petitioner in the F.I.R., the material that has transpired in course of investigation as is evident from the order of the learned Court below, the alleged recovery having been made from the poultry farm of Vijay Kumar Singh @ Vinay Singh and not this petitioner and especially the petitioner not having any antecedent under the Bihar Prohibition and Excise Act, 2016, it is directed that the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Desari (Chandpura) P.S. Case no. 8 of 2025 on
Patna High Court CR. MISC. No.10757 of 2025(2) dt.07-03-2025 3/3 furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court no. 1-cum-Additional District and Sessions Judge, Vaishali at Hajipur.
