The matter is being heard through video conferencing due to circumstances prevailing on account of Covid-19 pandemic.

Heard learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest in connection with Mahua P.S. Case No.573 of 2021 registered for offences under Section 414 of the Indian Penal Code and Sections 30(a), 32(1), 32(3), 40(i), 42(2) and 36 of the Bihar Prohibition and Excise Act, 2018.

The police on secret information has raided the place

Patna High Court CR. MISC. No.11433 of 2022(2) dt.01-04-2022 2/2 of occurrence from where 313 litres of illicit liquor were recovered from the pick-up van and Alto car but no person could be arrested. The police says that they could not get the names of accused persons from any independent witnesses. It has been submitted by learned counsel for the petitioner that there is no material to connect the petitioner with the alleged crime.

It seems that the police has found two abandoned vehicles and has implicated the petitioner and others. Considering the fact that the petitioner has no criminal antecedent, his application for anticipatory bail is allowed. Accordingly, let petitioner, above-named, in the event of his arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Excise Prohibition Court-II-cumAdditional District & Sessions Judge, Hajipur, Vaishali in connection with Mahua P.S.
