JUSTICE MOHIT KUMAR SHAH ORAL ORDER 14-09-2022 At the outset, the learned counsel for the petitioner seeks to correct the depiction of respondent no. 7, which has been inadvertently typed as Circle Officer, Rajnagar, instead of Circle Officer, Babubarhi, Madhubani. The necessary correction is permitted to be carried out during the course of the day. Though the present writ petition has been filed for removal of encroachment from the public land, made by the encroachers, however, it is submitted that the Circle Officer, Babubarhi, District-Madhubani i.e. the respondent no. 7 has already initiated Encroachment proceedings bearing

Patna High Court CWJC No.6428 of 2021(2) dt.14-09-2022 2/2 Encroachment case no. 10 of 2018-19, hence, the same be directed to be expedited.

Having regard to the limited prayer made by the learned counsel for the petitioner, I deem it fit and appropriate to dispose off the present writ petition with a direction to the respondent no. 7 to dispose off the aforesaid Encroachment case no. 10 of 2018-19, by passing the final order under Section 6(1) of the Bihar Public land Encroachment Act, 1956, in accordance with law and after hearing the affected parties, within a period of 12 weeks of receipt/ production of a copy of this order.
