JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be father-in-law of the deceased and is languishing in jail custody since 08-09-2015 in a case registered under Sections-304(B)/34 of the Indian Penal Code. The marriage of deceased had taken place in the year, 2010 whereas; according to prosecution case, she died in the year, 2015. The informant admitted in his written report that having got information regarding the killing of the deceased, he went to her matrimonial home but he did not find dead body of the deceased and thereafter, he went to Roh police station, where he found the dead body of the deceased.
The contention on behalf of the petitioner is that deceased was mother of two children and as a matter of fact, she

It is further contended by him that just after that aforesaid incident, an information regarding death of the deceased was given to the concerned police station and after that, police party reached there and took the dead body from house of the petitioner after making proper seizure list. Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Roh P.S. Case No. 63 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Nawada. (Hemant Kumar Srivastava, J) A.K.V./- U T
