JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 13-04-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Aurai P.S. Case No. 27 of 2016, registered under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. In course of investigation the name of the petitioner surfaced in the confessional statement of Raushan Kumar, except the confessional statement, there is nothing against the petitioner to show his involvement in the present case. Moreover, the petitioner is in custody since 26.02.2016, but he has not been put on T.I.P for identification, while informant has claimed to identify the culprits on seeing them again.

No.15003 of 2017 (2) dt.13-04-2017 2/2 Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Muzaffarpur in connection with Aurai P.S. Case No. 27 of 2016. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
