The petitioner seeks regular bail in connection with Special Case No.10639 of 2019 (arising out of Kotwali P.s.Case no.1060 of 2019) registered for offences punishable under Sections 30(a)/36(1)(2) of the Bihar Prohibition and Excise Act, 2016 .

Allegation against the petitioner is about recovery of 24 ltrs. of liquor and the petitioner was arrested from there. Submission of the learned counsel for the petitioner is that he has been falsely implicated in this case, having no criminal antecedent and he is in custody since 29.11.2019. There is no chance of tampering with the evidence. Heard learned A.P.P. also.

No.8402 of 2020(2) dt.27-02-2020 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise Act, Patna in connection with Special Case No.10639 of 2019 (Arising out of Kotwali P.S.Case No.1060 of 2019). Accordingly, this application is allowed.
