JUSTICE BIRENDRA KUMAR ORAL ORDER 08-05-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner is languishing in custody for the offences punishable under Sections 395 and 397 of the Indian Penal Code. The petitioner is not named in the F.I.R. The name of the petitioner figured in the confessional statement of the coaccused and submission is that Annexure-2 series reveals that other co-accused persons have already been allowed bail by this court in Cr. Misc. No. 37412 of 2016 and other criminal miscellaneous applications.

Considering the facts aforesaid, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each

Patna High Court Cr.Misc. No.15486 of 2017 (3) dt.08-05-2017 2/2 to the satisfaction of the learned 6th Additional District and Sessions Judge, Bhagalpur/Successor Court, in connection with Kahalgaon P.S. Case No. 570 of 2014, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court below shall be at liberty to take steps for cancellation of the bail bonds of the petitioner in this case.
