====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-04-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. Petitioner seeks regular bail in connection with Bibhutipur P. S. Case No. 350/2022 in a case registered for the offence punishable under Sections 302 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per prosecution case, while the informant along with her husband was going by motorcycle to Jhamatiya for Ganga Bath, on the way, two unknown persons, riding on motorcycle, intercepted them and opened fire upon the husband of the informant, as a result of which husband of the informant died.

4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is not named in the F.I.R.

No.11153 of 2025(2) dt.04-04-2025 2/2 Name of the petitioner transpired in this case during course of investigation, only on the basis of confessional statement of coaccused Sobhit Rai. Petitioner claims clean antecedent and he is in custody since 09.09.2024. Charge-sheet has already been submitted.

5. Learned A.P.P. for the State vehemently opposes the bail application.

6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Rosera, Samastipur in connection with Bibhutipur P. S. Case No. 350/2022.
