JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-04-2019 Petitioner seeks bail in anticipation of his arrest in connection with Babubarhi P.S. Case No. 209 of 2018, corresponding to CRI 2113 of 2018, registered for the offences punishable under Sections 341, 342, 323, 324, 307 and 385/34 of the Indian Penal Code.

Allegation against the petitioner along with other accused persons is of demanding extortion and assaulting the informant and others.

Submission of learned counsel for the petitioner is that wife of the petitioner has purchased a land from the relative of the informant and for that the present case has been filed and there is no specific allegation against the petitioner as per the FIR and all the injuries are simple in nature, except one and, that

Heard learned APP and learned counsel for the informant, who has opposed the prayer for anticipatory bail of the petitioner.

Having heard both sides and in the facts and circumstances, let petitioner, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-III, Madhubani, in connection with Babubarhi P.S.Case No. 209 of 2018, corresponding to CRI 2113 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
