JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 02.03.2015 in a case registered for the offences punishable under Sections 448, 376, 511 of the Indian Penal Code and 3 (i) (xi) of S.C./S.T. (Prevention of Atrocities) Act.

Petitioner is said to have made attempt to commit rape on the informant but submission on behalf of the petitioner is that the informant was illegally selling country made liquor under the protection of local police and as a matter of fact, petitioner had gone to take liquor but an altercation took place and the informant in collusion with local police lodged this case implicating the petitioner.

No.57280 of 2015 (2) dt.21-12-2015 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Shri S.N. Jha, Additional Chief Judicial Magistrate-II, Purnea in connection with Baisi P.S. Case No. 30 of 2015.
