The petitioner is languishing in custody since 13.09.2018 in a case registered for the offences punishable under Sections 399 and 402 of the Indian Penal Code and Section 25 (1-B)a, 26 and 35 of the Arms Act. The prosecution case as per the written report of S.I., Anil Kumar of Jehanabad police station submitted to SHO, Jehanabad (town) Police Station is to the effect that on 11.09.2018, the informant received an information that some miscreants are preparing to commit a dacoity, whereupon a raid was laid, 5 persons were apprehended on the spot and 2 to 3 persons escaped from the scene. It is further alleged that from

Patna High Court CR. MISC. No.12304 of 2019(2) dt.28-02-2019 2/2 the possession of the petitioner three live cartridges were recovered.

It is submitted by learned counsel for the petitioner that investigation has already been concluded and similarly situated co-accused has been granted bail by a Co-ordinate Bench of this Court vide order dated 19.02.2019 passed in Cr. Misc. No.9904 of 2019.

Learned APP for the State submits that three live cartridges has been recovered from the conscious possession of the petitioner.

Considering the fact that investigation has already been concluded and similarly situated co-accused has been granted bail by a Co-ordinate Bench of this Court, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Jehanabad in connection with Jehanabad (town) P.S.
