JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-02-2020 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Excise Case No. 24 of 2020 arising out of Bhabua P.S. Case No. 10 of 2020 for the offenses under Sections 37 (i) (ii)of the Bihar Prohibition & Excise Act, 2016.

Allegation against the petitioner is that he has taken liquor and committed offence under the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 05.01.2020.

Considering the nature of allegation, the Court is inclined to grant bail to the petitioner, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.

Patna High Court CR. MISC. No.8307 of 2020(2) dt.06-02-2020 2/2 25,000/-(Twenty five Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-III-cum-Special Judge (Excise), Kaimur at Bhabua in connection with Excise Case No. 24 of 2020 arising out of Bhabua P.S. Case No. 10 of 2020.

However, in future if the petitioner is found involved in similar other case the Court below shall be at liberty to cancel his bail bond.
