The petitioner seeks bail in connection with Chandi P.S. Case No. 40 of 2013 registered under Section 396 of the Indian Penal Code.
The prayer for bail of the petitioner was earlier rejected by this Court vide order dated 25.11.2014 passed in Cr. Misc. No. 42530 of 2014.
Considering the gravity of the offence and the fact that the petitioner was identified by two witnesses including the informant in the test identification parade, I am not inclined to
Patna High Court Cr.Misc. No.15981 of 2017 (2) dt.12-04-2017 2 / 2 grant bail. Accordingly, the prayer for bail is rejected. However, since the petitioner is in custody for more than three years, the Sessions Judge, Bhojpur at Ara is directed to personally supervise progress of the trial and ensure that no undue delay is caused in bringing the trial of the petitioner to its logical conclusion.
Registry is directed to communicate a copy of the order to the Sessions Judge, Bhojpur at Ara.
