JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 24-03-2017 Heard learned counsel for the petitioner, learned counsel for the informant and the learned A.P.P. for the State. The petitioner is accused in connection with Parbatta P.S. Case No. 43 of 2017, registered under Sections 448, 341, 323, 354(B), 504 and 506/34 of the Indian Penal Code. The accusation is that petitioner used to visit at the house of Pappu Yadav, maternal uncle of informant, to teach the informant and her cousin. In that course, petitioner made attempt to outrage her modesty on pretext to perform the marriage and also put Sindur at her forehead. Thereafter, petitioner took the informant at his house but she was abused there by petitioner and his family members and also driven out from there. Learned counsel for the petitioner submits that, in fact,

Thereafter, she used to reside at the house of her maternal uncle and only to give pressure to the petitioner to perform the marriage the present case has been lodged with false allegation. It is further submitted that petitioner has no criminal antecedent and is in custody since 08.02.2017. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Khagaria, in connection with Parbatta P.S. Case No. 43 of 2017. Out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
