In this case, the petitioner is seeking bail in connection with Kudhani (Turki O.P) P.S. Case No. 181 of 2015 registered for offences under Sections 467,468,471,420/34 of the Indian Penal Code.
There is allegation against the petitioner that he approached the informant and said that one Sushila Devi was intending to sale her land and on the next date the petitioner along with two ladies came and introduced her as land lady. Whereupon the transaction was fixed in 10 lacs out of which three lacs was advance paid to her in presence of the present petitioner and later on, on the date of execution rest money was given. Ten days before lodging the FIR when he has gone to take possession at the land, another lady came and informed that it is her land and she had not executed any sale of the land. Patna High Court Cr.Misc. No.56992 of 2015 (4) dt.19-02-2016 2/2 Court has asked the petitioner to return Rs. 3,00,000/- to the informant but today the counsel for the petitioner submitted that he has no instruction regarding payment.
In view of the matter, this Court is not inclined to grant bail to the petitioner. The application is rejected. However, the petitioner is at liberty to renew his bail after one year of the judicial custody.
