JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-01-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 307, 323, 324, 341, 379 and 448 of the Indian Penal Code. Prosecution case is that the petitioner assaulted with 'gupti' to the informant though the injury has been found to be simple in nature.
It is submitted by learned counsel for the petitioner that after investigation, the petitioner was not sent up for trial and final form was submitted but differing with the final form cognizance has been taken. Other similarly situated accused person Gorakh Nath Singh has been granted anticipatory bail vide Criminal Miscellaneous No.50038 of 2015. Considering that the petitioner was not sent up for trial, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Saran at Chapra in connection with Chapra Muffasil P.S.
