Petitioner is in custody since 27.10.2016 in connection with Birpur P.S. Case No. 267 of 2016 registered under Sections 414 of the Indian Penal Code and Section 30(a), 36, 38(1) of the Bihar Excise (Amendment) Act.

Learned counsel for the petitioner has submitted that the petitioner, who is of clean antecedent, has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner is rotting in custody for the last three months.

Considering the nature of accusation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand rupees only) with two sureties of the like
