The petitioner apprehends his arrest in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act and sections 8/20 and 22 of the Narcotic Drugs and Psychotropic Substances Act. As per the prosecution case, on secret information a raid was conducted and from possession of Raj Gaurav 6 pcs. of 180 ml foreign liquor and 498 gms. of Charas and from possession of Rakesh Kumar 6 pcs. of 180 ml. Foreign liquor and 472 gms. of Charas and one mobile phone was recovered who disclosed the name of this petitioner.
It is submitted that nothing has been recovered from conscious possession of this petitioner. Petitioner has been made
Patna High Court CR. MISC. No.18288 of 2023(3) dt.13-04-2023 2/2 accused in this case only on disclosure made by the apprehended accused persons.
Petitioner claims clean antecedent.
Considering the facts aforesaid, petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 3rd Additional Sessions Judge, Muzaffarpur in connection with Gaighat PS Case No. 312 of 2022 corresponding to NDPS Case No. 181 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
