Patna High Court CWJC No.4258 of 2025 dt.02-05-2025 2/3 Advocate for the petitioner submits that despite the residents/villagers of Village - Gangwara, within the Gangwara Buzurg Gram Panchayat, having offered their lands for the construction of a Panchayat Sarkar Bhawan, the respondents are constructing the same in the neighbouring Village - Mehsaul.

3. Mr. S.D. Yadav, the learned AAG-9 has informed this Court that no suitable land was found in Village - Gangwara. The Gangwara Buzurg Gram Panchayat comprises of three villages, one being Village - Mehsaul. He has further submitted that the first choice of the respondents for selection of the site was in the headquarter village, but on not finding any suitable land, decision was taken to construct the building (Panchayat Sarkar Bhawan) in the Village - Mehsaul, which forms part of the same Gram Panchayat.

4. The guideline in this regard is that preference has to be given to the government land.

5. In that view of the matter, the petitioner

Patna High Court CWJC No.4258 of 2025 dt.02-05-2025 3/3 has not made out any case for our interference.

6. The petition stands dismissed.
