JUSTICE ARUN KUMAR ORAL ORDER 28-06-2017 Heard learned counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Bhorey P.S. Case No.39 of 2017 registered under Sections 272, 273, 308 and 420 of the Indian Penal Code and 30(a), 35, 38 of the Prohibition and Excise Act, 2016.

Allegation in brief is that the petitioner was found travelling in a car in which 540 bottles of illicit spicy country made liquor having 200 ml quantity kept in 12 cartoons were recovered.

Learned counsel for the petitioner submits that petitioner is a student and he had taken the lift. Neither the car belongs to him nor he is concerned with seized liquor and the driver of the vehicle escaped away. Moreover, he has no criminal antecedent

Patna High Court Cr.Misc. No.15334 of 2017 (5) dt.28-06-2017 2/2 and has been in custody for approximately four months. Having considered the said facts and circumstances, the petitioner, namely, Chandan Pandey is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief judicial Magistrate-XII, Gopalganj in connection with Bhorey P.S. Case No.39 of 2017.
