The petitioner seeks bail in a case instituted for the offences under Sections 395, 412 of the Indian Penal Code and 25(1-B), 26 and 35 of the Arms Act.

Prosecution case, in short, is that the accused persons, variously armed, entered into the hostel run by the informant and assaulted one person and looted cash amount. It has been submitted on behalf of the petitioner that the petitioner is in custody since 17.5.2018. Chargesheet/prosecution report has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The petitioner has remained in custody for a year.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Khagaria (Gangaur) P.S. Case No. 308/18.
