The petitioner is in custody since 23.02.2017 in connection with Govt. Complaint Case No. C-26(7) of 2017, registered for offences punishable under Sections 30(a) and 37(b) of the Bihar Excise (Amendment ) Act, 2016.
Allegation of recovery of 200 ML of foreign liquor from the possession of the petitioner and also he was apprehended on drunken condition.
It has been submitted on behalf of the petitioner that in this case only 200 ML of foreign liquor has been recovered from the possession of the petitioner, for which he has been sufficiently punished as has remained in judicial custody for about two months
Patna High Court Cr.Misc. No.17784 of 2017 (3) dt.19-04-2017 2/2 and has no criminal antecedent.
Heard learned A.P.P. also.
Having heard both sides, considering the facts and circumstances of the case, quantity of recovery and also that petitioner has no criminal antecedent, let petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura, in connection with Govt. Complaint Case No. C-26(7) of 2017, subject to the following conditions:- It is also made clear if the petitioner again found involved in any of such offences, prosecution will be free to move for cancellation of his bail bonds.
