The petitioner seeks bail in connection with Warsaliganj P.S. Case No. 241 of 2015, registered under Section 302, 201/34 of the Indian Penal Code.

The accusation is that on 25.08.2015, Himanshu aged about five years, son of the informant, was playing out of his house, but he did not return to his house and on the next morning his dead body was recovered from a drain. The informant raised suspicion against Vijay Prasad, Bipin and Gauri Shankar due to earlier dispute having hand in the murder of his son.

Learned counsel for the petitioner submits that

Patna High Court Cr.Misc. No.14173 of 2017 (2) dt.07-04-2017 2/2 petitioner is not named in the F.I.R. The informant in his restatement disclosed the name of the petitioner, his husband Tuni Prasad, daughter Gudi Kumari saying that all were seen moving in the morning of 27.08.2015 at the place of occurrence, except the suspicion raised by the informant, there is nothing against the petitioner to show her involvement in the present case. The petitioner being the lady has no criminal antecedent is in custody since 05.01.2017.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate, Nawada in connection with Warsaliganj P.S. Case No. 241 of 2015. (Rajendra Kumar Mishra, J) manish/- U T
