JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-04-2019 This is an application for grant of anticipatory bail in connection with Kasba P.S. Case No. 296 of 2018, disclosing offences under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act 2016. Allegation is of recovery of two bottles of 750 ml each foreign liquor was recovered from the house of the petitioner.

Submission of learned counsel for the petitioner is that the petitioner has falsely been implicated in this case and having no criminal antecedent and also ready to abide by any condition imposed upon him.

Heard learned A.P.P. also.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above

Patna High Court CR. MISC. No.13050 of 2019(3) dt.30-04-2019 2/2 named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge 2nd-cum-Special Judge, Excise, Purnea, in connection with Kasba P.S. Case No. 296 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
