JUSTICE RAKESH KUMAR ORAL ORDER 21-01-2016 Heard Sri Hare Krishna Prasad, learned counsel for the petitioner , Mr. Md. Arif, learned Addl. Public Prosecutor as well as Sri Surendra Kishore Thakur, learned counsel, who has appeared on behalf of the informant.

The petitioner, who is in custody since 27.06.2015 in connection with Khagaria (Gangaur) P.S. Case no.233 of 2015 registered for the offence under Section 307 and other allied Sections of the Indian Penal Code, has prayed for grant of bail. Learned counsel for the petitioner submits that in this case , there are two versions. He submits that in the present case, it was alleged that petitioner gave fire-arm injury on the head of victim Hakim Yadav, whereas a complaint was filed by grandmother of the victim, in which it was alleged that the informant of

Patna High Court Cr.Misc. No.56656 of 2015 (4) dt.21-01-2016 2/2 the case had fired.

Learned Addl. Public Prosecutor has opposed the prayer for bail of the petitioner.

In this case, earlier the case diary was called for, which has been received. Learned Addl. Public Prosecutor by way of referring to paragraph nos. 9, 11 and 26 of the case diary submits that there is material against the petitioner suggesting his involvement in the present case.

Keeping in view of nature of accusation and period of custody, at the moment, the Court is not inclined to grant bail to the petitioner. The petition stands dismissed. (Rakesh Kumar, J) NKS/- U
