The petitioner seeks bail in connection with Rahui P. S. Case No. 392 of 2019 dated 20.10.2019 registered for offences under Sections 399 and 402 of the Indian Penal Code and Sections 25 (1-b)a, 26 and 35 of the Arms Act.

The petitioner is said to be in custody since 20.10.2019.

On search of the ambulance, some persons were arrested including the petitioner. From others, incriminating materials in the shape of cash and firearms have been recovered. However, from the possession of the petitioner, only a mobile phone has been recovered.

The petitioner has an explanation for being present in the Maruti Van which was used as an ambulance. The petitioner was to be taken to a hospital for treatment of his stomach ulcer.

The petitioner has clean antecedents.

Regard being had to the period of custody of the petitioner, his clean antecedents and recovery of only mobile telephone from his possession, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Assistant Chief Judicial Magistrate, 1st Class, Biharsharif,
