JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-04-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Sahar P.S. Case No. 21 of 2016, registered under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act. The accusation is that on 22/23-02-2016, petitioners along with his brother and five others named in the F.I.R. went to the hut of the mother of informant and made query about his father. Then mother of the informant told that Rajendra Singh, father of the informant, is sleeping in another hut. Thereafter, all of them went in the said hut and carried his father. Thereafter, informant heard the sound of firing then he reached there and saw his father was in pool of blood lying dead on the ground. Learned counsel for the petitioner submits that

Patna High Court Cr.Misc. No.17577 of 2017 (2) dt.28-04-2017 2/2 occurrence is said to be held in night, but source of light for identification has not been disclosed. Further submission is that similarly situated co-accused Murlidhar Rai has already been granted privilege of bail by this Court vide order dated 19.07.2016 passed in Criminal Misc. No. 28640 of 2016. The petitioner is in custody since 25.12.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara in connection with Sahar P.S.
