Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 16.09.2015 in a case registered for the offences punishable under Section 376 read with Sections 511, 506/34 of the Indian Penal Code on the accusation that he along with others went at the house of the informant and made attempt to commit rape on her. Submission on behalf of the petitioner is that there was some dispute between petitioner and husband of the informant on the point of making payment in business transaction and the husband of the informant got lodged the present case against the

Patna High Court Cr.Misc. No.57207 of 2015 (2) dt.21-12-2015 2/2 petitioner and others. It is also submitted on behalf of the petitioner that petitioner is resident of Village-Bir Nagar, P.S. Bhargama, District Araria whereas informant is resident of Village-Chakamka Bazar, P.S. Janki Nagar, District Purnea but even then she made the petitioner as accused disclosing his parentage and complete address.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri L.B. Paswan, Judicial Magistrate 1st Class, Purnea in connection with Janki Nagar P.S. Case No. 107 of 2015.
