The present writ petition has been filed by the petitioner for issuance of writ in the nature of Mandamus directing the District Magistrate, Jehanabad, as well as the Circle Officer, Makhdumpur, to do online registration of the land in question, situated at Mauza-Bhimpura, Thana No.230, Khata Nos.140, 141, Plot Nos.1505, 836, 799 - 1079, area 3

Learned Counsel for the petitioner submits that petitioner filed representation dated 08.10.2024 (AnnexureP/7) before the District Magistrate, Jehanabad, but no decision has been taken by the District Magistrate and it is, therefore, he has filed the present writ petition before this Court seeking direction to the District Magistrate to consider the case so that his lands be figured online on the website of the department. Counsel submits that the petitioner was working in Military Service and government has settled the land in the name of the petitioner under Bihar Privileged Persons Homestead Tenancy Act, 1947 by virtue of which settlement of Jamabandi has been opened bearing Jamabandi No.40 of 1990-91. Counsel submits that the hard copy of the documents are available with him with regard to the said land, but he filed application before the Circle Officer, Makhdumpur, to figure his settled land online but no steps was taken by the Circle Officer. It is due to this reason he has filed application before the Circle Officer and then to the District Magistrate.
4. Learned Counsel for the State submits that it transpires that his representation is pending but no order has been taken on the same. In this background, he submits that the
Patna High Court CWJC No.3339 of 2025 dt.04-03-2025 3/3 District Magistrate, Jehanabad, may be directed to pass order on the representation of the petitioner in accordance with law.
5. It transpires to this Court that petitioner has attached a copy of the letter issued by the Bihar Land Reforms Department, Government of Bihar, dated 03.01.2018 page-3236 of the writ petition.

Considering the fact that the representation is still pending, this writ petition is disposed off directing the District Magistrate, Jehanabad, to pass order on the representation dated 08.10.2024 (Annexure-P/7) filed by the petitioner. The petitioner is directed to place this order before the District Magistrate and District Magistrate upon receiving the same shall pass a reasoned and speaking order on the representation filed by the petitioner within 90 days thereafter. It is made clear that if District Magistrate is required more documents he shall demand the same from the petitioner. The final order shall be passed only after granting opportunity to the petitioner either in person or through his Counsel.
