The Petitioners seek bail in Simri P.S. Case No. 123 of 2016 instituted for the offence under Section(s) 467, 468, 471, 420, 401, 414, 201, 120B of the Indian Penal Code. It is alleged in the written report that the police received information that one stolen Bolero engine has been carried by three persons on Scorpio vehicle from Chandni Chowk to Dharbhanga. The police intercepted the Scorpio vehicle and recovered one engine as mentioned in the written report which was carried by these petitioners and one Md. Mojim and on interrogation the petitioners disclosed that they were carrying the
Patna High Court Cr.Misc. No.9637 of 2017 (2) dt.11-04-2017 2/2 engine for one Amit Jha's vehicle. The petitioners also disclosed that they had purchased the engine from one Md. Shamim @ Biltu who used to sale the engine after changing the number with the help of punching machine.
It has been submitted on behalf of the petitioners that co-accused Md. Mujim has been granted bail by a coordinate Bench of this Court vide Cr. Misc. No. 8894 of 2017. From the allegation itself, it appears that there is no any specific case lodged by any person that the engine which was carried by the petitioners was stolen engine.
In the facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the Petitioners, above named, be released on bail on furnishing bail bond of 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Darbhanga in connection with Simri P.S. Case No. 123 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioners.
