The petitioners are apprehending their arrest in a case registered under Sections 341, 323, 379, 504, 307/34 of the Indian Penal Code.
The prosecution case, in brief, is that the accused persons tried to press the throat of son of the informant and it is also alleged that the accused persons took the locket worth Rs. 5,000/- from the neck of the son of the informant.
Patna High Court CR. MISC. No.15592 of 2019(2) dt.13-03-2019 2/2 It has been submitted on behalf of the petitioners that the petitioner Nos. 1, 2, 4 & 5 have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have been falsely implicated in the present case. No injury has been caused to anyone. The matter has already been compromised between the parties vide Annexure-2 to the present application.
On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Patna City in connection with Fatwa P.S. Case No. 288 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
