The petitioners have filed this civil miscellaneous petition against the order dated 02.01.2018 passed by Sub Judge I, Khagaria in Title Suit No.81 of 1999 by which Pleader
Patna High Court C.Misc. No.649 of 2018 (2) dt.30-07-2018 Commissioner was appointed to verify the physical features of the land.
The learned counsel for the petitioners submits that the petitioners are the defendants in the court below. The plaintiffs filed suit for partition. There is an ad interim order for maintaining status quo but the plaintiffs made construction on the disputed land and it appears that the plaintiffs only made prayer for appointment of Pleader Commissioner to report about the physical features of the disputed land. The Court finds that to know about the physical features of the disputed land, the appointment of Pleader Commissioner is necessary.
Taking into consideration the facts aforesaid, I do not find any jurisdictional error or illegality in the order impugned. Accordingly, this civil miscellaneous petition is dismissed. (Prabhat Kumar Jha, J) Saurabh/- U
