JUSTICE BIRENDRA KUMAR ORAL ORDER 28-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner is languishing in custody for the offences punishable under Sections 341, 323, 376, 511 and 504/34 of the Indian Penal Code.

Allegation is that the petitioner along with others attempted to outrage the modesty of the informant. When informant went to make complaint, other accused persons allegedly committed assault.

Submission is that the wife of this petitioner has lodged Sakra P.S. Case No.320 of 2016 with almost identical allegation of attempt to outrage the modesty against the husband of the informant of this case.

Patna High Court Cr.Misc. No.10402 of 2017 (3) dt.28-03-2017 Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.

cum Sub-Judge-13th, Muzaffarpur/Successor Court, in connection with Sakra P.S. Case No.319 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
