====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 19-02-2019 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Excise Case No. 25 of 2019 arising out of Makhdumpur (Tehta O.P.) P.S. Case No. 06 of 2019 registered for the offence punishable under Section 30(a) of the Bihar Prohibition & Excise Act.

The allegation is regarding recovery of 682.875 litres of illicit liquor from the out house of the petitioner, which had no shutters or windows.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is submitted that the petitioner has a clean antecedent. It is further submitted that since the out house of the petitioner is far

Patna High Court Cr.Misc. No.9507 of 2019(2) dt.19-02-2019 2/2 away from the residential house of the petitioner, the possibility of the illicit liquor being kept by unknown persons cannot be ruled out. The petitioner is stated to be languishing in custody since 07.01.2019.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Jehanabad in connection with Excise Case No. 25 of 2019 arising out of Makhdumpur (Tehta O.P.)
