The petitioner seeks bail in Laheri P.S. Case No. 347/2016, registered for the offences punishable under Section 307 and other sections of the Indian Penal Code. The informant alleged that Md. Shakil, Md. Shamim and Md. Bholu (petitioner) assaulted his son with sharp-edged weapon, but it appears from perusal of the order of learned Sessions Judge, Nalanda that the injured in para 9 of the casediary disclosed that the petitioner pushed him down on the ground, thereafter, Md. Shakil Mian inflicted blow with sharp-cutting weapon on his neck. The petitioner is not alleged to have given blow with sharp-edged weapon. He is in custody since 08.02.2017.

Patna High Court Cr.Misc. No.12573 of 2017 (2) dt.28-03-2017 The learned counsel for the informant as well as learned A.P.P. however, vehemently opposed the prayer for bail of the petitioner, but did not dispute this fact.

Considering the facts aforesaid, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate Ist, Nalanda at Biharsharif in connection with Laheri P.S. Case No. 347/2016.
