The petitioner seeks bail in Chhatapur P.S. Case No. 355 of 2016, registered for the offences punishable under Sections 302, 201 and 120B of the Indian Penal Code.

The informant, own brother of the deceased, alleged that his brother was sleeping in the shop on the date of occurrence and the shop was found locked from outside. After sometime he got information that the dead body of his brother Depen Yadav was lying by the side of the road. The informant suspected that the petitioner might have killed his brother as he had enmity with him. Learned counsel for the petitioner submits that save and except suspicion there is no material. The witnesses have suspected only on the ground that the petitioner had enmity with

Considering the facts aforesaid and the fact that on mere suspicion name of the petitioner is mentioned in the FIR, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-II, Supaul in Chhatapur P.S. Case No. 355 of 2016.
