The petitioner apprehends his arrest in connection with Barari P.S. Case No. 183 of 2020 registered for the offence under Sections 341, 323, 379, 498 (A), 494, 504, 506/34 of the Indian Penal Code. The petitioner is the husband of informant. There are allegations and counter allegations made by both the parties and they cannot be verified in the anticipatory bail proceeding. In these circumstances, the prayer for anticipatory bail of the petitioner is allowed. Under the above facts and circumstances, let above named petitioner, in the event of his arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Katihar in connection with Barari P.S. Case No. 183 of 2020, subject to the conditions as laid down under Section 438 (2) of the

Patna High Court CR. MISC. No.20251 of 2021(2) dt.08-12-2021 2/2 Cr.P.C.

The wife of the petitioner has filed Maintenance Case No. 78 of 2020, which is pending in the Court of Principal Judge, Family Court, Katihar.

The Principal Judge, Family Court, Katihar is directed to decide the above Maintenance Case within a period of next three months.

Petitioner has not appeared in the Maintenance case then also the case will proceed and now this order is given in presence of the Advocate for the petitioner.

On 13.12.2021 the petitioner shall appear before the Principal Judge, Family Court, Katihar through his Advocate. Thereafter the proceeding for Maintenance will continue and decided as directed above.

After conclusion of the maintenance case, report be sent to this Court about the same.
