The petitioners seek bail in Amarpur P.S. Case No. 03/2016 registered for the offences punishable under Section 307 and other sections of the Indian Penal Code.

The informant Bablu Singh alleged that Ujagar Singh, Ranjit Singh, Randhir Singh and Manju Devi came and began to abuse the informant. The informant protested on such, all the accused persons assaulted her with sticks. On alarm Subodh Singh and Manoj Singh came, but the accused persons also assaulted them with sticks.

Learned counsel for the petitioners submits that there is counter version bearing Amarpur P.S. Case No. 02/2016. Omnibus

Patna High Court Cr.Misc. No.15411 of 2017 (2) dt.20-04-2017 and general allegation of assault is made against the petitioners and they assaulted Subodh Singh, Bablu Singh and Manoj Singh. From perusal of annexure-3 it would appear that Bablu Singh (except one injury) and Manoj Singh got simple injury. Subodh Singh got one incised wound on head which is opined to be grievous in nature, but the informant has not stated who caused grievous injury to Subodh Singh. It is further submitted that Subodh Singh got injury caused by sharp-cutting weapon, but the petitioners are alleged to have assaulted with sticks and by the stick no sharp-cut injury can caused. Bablu Singh also got one grievous injury on joint on account of fracture of bone. The petitioners are in jail for more than three months.

Considering the facts aforesaid, the petitioners abovenamed, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Banka in connection with Amarpur P.S. Case No. 03/2016. (Prabhat Kumar Jha, J.)
