While informant's brother Jairam Yadav along with other co-villagers was returning from market, he was assaulted by Nagendra Paswan and Dinesh Paswan with Garasa and on account thereof, he succumbed to his injury. Hira Yadav, Mukesh Yadav, Ram Chandra Yadav, Ram Janam Yadav, Arvind Yadav, Dayanand Yadav, Rajesh Yadav were also assaulted and for that, there happens to be specific assertion in the written report. Petitioner is not named in the F.I.R. From the order impugned, it is evident that his presence has been perceived as per statement of the injured witnesses during course of occurrence. Petitioner happens to be under custody since 10.09.2015.

Patna High Court Cr.Misc. No.58447 of 2015 (02) dt.05-02-2016 Accordingly, petitioner, Indradeo Manjhi is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Wazirganj P.
