JUSTICE BIRENDRA KUMAR ORAL ORDER 18-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 25(1-B)a/26/35 of the Arms Act and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

A pistol and about four liters of country-made liquor were recovered from the possession of the petitioner. Submission is that petitioner is in custody since 28.11.2016 and has stated on oath that he has got no criminal antecedent.

Considering the recovery of fire-arm from the possession of the petitioner, let petitioner, above named, be

Patna High Court Cr.Misc. No.18308 of 2017 (2) dt.18-04-2017 2/2 enlarged on bail on completion of nine months of custody on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Samastipur/Successor Court, in connection with Khanpur P.S. Case No.117 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
