The Petitioner seeks bail in Dehri (Town) P.S. Case No. 18 of 2017 instituted for the offence under Section(s) 272, 273 of the Indian Penal Code and Sections 30(i), 37(i), 38(i)(ii), 41(i)(ii) of the Bihar Excise and Prohibition Act, 2016. It has been submitted that there is no recovery from the conscious possession of the petitioner. As per written report, country made liquor and foreign liquor were recovered from the shop of co-accused Satya Kumar Sharma. It is alleged that this petitioner was also caught while running away from that shop. In the seizure list, it has been mentioned that recovery has been made from the shop of Satya

The petitioner is said to be in custody since 11.01.2017.

It has been mentioned in para 3 of the petition that petitioner has got no criminal antecedent. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Dehri, Rohtas in connection with Dehri (Town) P.S.
