1. Heard the parties.
2. The petitioner has preferred this application for grant of anticipatory bail apprehending his arrest in connection with Nawanagar P.S. Case no. 316 of 2024, registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.
3. As per the prosecution case, while the accused persons managed to escape, 30 litres of liquor was recovered from under the seat of the scooty.
4. It is the case of the petitioner that no incriminating article has been recovered from the petitioner's possession. He has no concern with the seized liquor nor with the vehicle from which the alleged recovery is said to have taken place. He undertakes to cooperate in the case/trial.
5. The application for anticipatory bail is opposed by
Patna High Court CR. MISC. No.10410 of 2025(2) dt.21-03-2025 2/2 learned A.P.P. for the State.
6. Having perused the materials on record and taking into consideration the allegation against the petitioner in the F.I.R, his not having been arrested at the spot and especially the petitioner not having any concern with the vehicle from which the alleged seizure is said to have taken place, it is directed that the petitioner above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Nawanagar P.S. Case no. 316 of 2024 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Excise Court no.-2 at Buxar.
