The petitioner seeks regular bail in connection with Khodabandpur PS case no. 250 of 2018 registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act, 2016.

The allegation is regarding recovery of 16.2 liters of illicit liquor from a motorcycle stated to be that of the petitioner herein.

The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case and he is having clean antecedent. The learned counsel for the petitioner has referred to paragraph no. 9 of the petition, wherein it has been stated that the petitioner has got no

Patna High Court Cr.Misc. No.9990 of 2019(2) dt.19-02-2019 2/2 concern with the motorcycle in question. Lastly, it is submitted that the petitioner is languishing in custody since 30.11.2018. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the abovenamed petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge, Excise, Begusarai in connection with Khodabandpur PS case no. 250 of 2018.
